Terms of service and artwork sales

These terms apply to artandtwist.com and purchases from Art and Twist, operated by an Israeli authorized dealer (Osek Murshe), no. 058076274. Registered legal name: (REGISTERED LEGAL NAME). The seller and transaction details are identified on the invoice or written agreement.
Artwork and order details
The agreed sale record identifies the artwork, artist attribution, title if known, medium, dimensions, date if known, condition, framing, signature/edition details where relevant and included documents. Available provenance and condition information may be requested before purchase; known material damage or restoration must be disclosed. A listing or enquiry alone does not reserve an artwork.
Descriptions, authenticity commitments and title rights are subject to the sale agreement and applicable law, including Florida art-dealer and sales laws where relevant. No general disclaimer overrides an express artwork description or non-waivable authenticity or title rights. A certificate is included when identified in the sale record; an invoice alone is not an authenticity certificate.
Prices, payment and delivery
Prices are in USD unless the sale record expressly states otherwise. The artwork price, discount, shipping, packing, insurance and applicable taxes are disclosed before payment. Applicable VAT or sales tax is calculated and displayed at checkout according to the delivery destination and applicable tax rules. Any deposit, installment or additional service must be agreed in writing. We correct errors transparently and refund amounts owed if an order is cancelled.
Shipping origin, destination, dispatch and delivery arrangements must be confirmed. Ownership transfer, transit risk and insurance follow the written agreement and mandatory law; courier handover does not automatically remove our legal obligations. See the Shipping policy and Refund policy. These artwork terms prevail over conflicting general website disclaimers and do not retrospectively change an agreed sale.
Copyright, use and value
Buying a physical artwork does not transfer copyright or reproduction rights unless expressly agreed. Website images and text remain protected. Do not misuse the site, supply false details, infringe rights, send malware or bypass security. External services and links have their own terms and privacy notices. Personal information is handled under our Privacy policy.
We do not guarantee resale value, appreciation or investment returns. Website availability and screen colors can vary, but this does not excuse a materially inaccurate artwork description.
Rights and disputes
Contact us first about a dispute. Applicable law and any lawful written jurisdiction agreement apply; mandatory consumer protections, including those in Israel or the United States where applicable, are preserved. Nothing excludes liability or remedies that cannot legally be excluded. Neither language version overrides mandatory rights. Future updates apply prospectively and do not rewrite an existing order.

היצירה ופרטי ההזמנה
רישום המכירה המוסכם יזהה את היצירה, הייחוס לאמן, השם ככל שידוע, החומר, המידות, השנה ככל שידועה, המצב, המסגור, פרטי חתימה או מהדורה ככל שרלוונטיים והמסמכים הנלווים. ניתן לבקש מידע זמין על מקור היצירה ומצבה לפני רכישה; יש לגלות נזק מהותי או שיקום ידועים. פרסום או פנייה אינם כשלעצמם שומרים יצירה.
תיאורים, התחייבויות מקוריות וזכויות בעלות כפופים להסכם המכירה ולדין החל, לרבות דיני סוחרי אמנות ומכר בפלורידה, ככל שרלוונטיים. הסתייגות כללית אינה מבטלת תיאור מפורש של יצירה או זכויות מקוריות ובעלות שלא ניתן להתנות עליהן. תעודה נכללת כאשר צוינה ברישום המכירה; חשבונית לבדה אינה תעודת מקוריות.
מחירים, תשלום ומסירה
המחירים בדולר ארצות הברית, אלא אם צוין אחרת במפורש ברישום המכירה. מחיר היצירה, ההנחה, המשלוח, האריזה, הביטוח והמסים החלים יימסרו לפני התשלום. מע״מ או מס מכירה החלים על העסקה מחושבים ומוצגים בקופה לפי יעד המסירה וכללי המס החלים. מקדמה, תשלומים או שירות נוסף יוסכמו בכתב. נתקן טעויות בשקיפות ונחזיר סכומים המגיעים במקרה של ביטול הזמנה.
יש לאשר את מקור המשלוח, היעד, ההוצאה למשלוח והמסירה. העברת הבעלות, הסיכון בהובלה והביטוח יהיו לפי ההסכם בכתב והדין המחייב; מסירה לשליח אינה מסירה אוטומטית את חובותינו החוקיות. ראו מדיניות משלוחים ומדיניות החזרים. תנאי אמנות אלה גוברים על הסתייגויות כלליות סותרות באתר ואינם משנים למפרע מכירה שכבר הוסכמה.
זכויות יוצרים, שימוש וערך
רכישת יצירה פיזית אינה מעבירה זכויות יוצרים או שכפול אלא אם הוסכם כך במפורש. התמונות והטקסט באתר מוגנים. אין לעשות שימוש לרעה באתר, למסור פרטים כוזבים, להפר זכויות, לשלוח תוכנה מזיקה או לעקוף אבטחה. שירותים וקישורים חיצוניים כפופים לתנאים ולמדיניות שלהם. מידע אישי מטופל לפי מדיניות הפרטיות.
איננו מבטיחים שווי מכירה עתידי, עליית ערך או תשואה. זמינות האתר וצבעים על המסך עשויים להשתנות, אך אין בכך להצדיק תיאור מהותי שאינו מדויק.
זכויות ומחלוקות
פנו אלינו תחילה במקרה של מחלוקת. יחולו הדין החל וכל הסכמה חוקית בכתב בעניין סמכות שיפוט; הגנות צרכן מחייבות, לרבות בישראל או בארצות הברית ככל שחלות, נשמרות. אין פטור מחבות או מסעד שלא ניתן לפטור מהם בדין. אף אחת מהשפות אינה גוברת על זכויות מחייבות. עדכונים עתידיים יחולו להבא ואינם משנים הזמנה קיימת.
